Acceptance of Terms

By accessing or using airythemes.com ("the Website") or any plugin distributed by Airythemes ("the Plugins"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use our Website or Plugins.

These Terms constitute a legally binding agreement between you and Nxlogy Solutions Private Limited, a company incorporated under the Companies Act, 2013, with its registered office in Noida, Uttar Pradesh, India, operating the Airythemes brand.

2. About Airythemes

Airythemes is a product brand of Nxlogy Solutions Pvt Ltd that develops and distributes free and premium WordPress plugins. Our free plugins are published on WordPress.org under GPL v2 or later license. Premium ("Pro") versions may be sold separately through our website or via Freemius.

3. Plugin License

Free plugins (GPL v2 or later)

All Airythemes plugins distributed on WordPress.org are licensed under the GNU General Public License v2.0 or later. This means:

• You may use the plugins on unlimited websites, including client sites
• You may modify the plugin code for your own use
• You may redistribute the plugins, provided you do so under the same GPL license
• Commercial use is permitted
• No attribution is required (though appreciated)

Pro plugins

Pro versions of Airythemes plugins are commercial products. Each Pro license allows installation on a specific number of sites as stated at the time of purchase. Pro licenses are non-transferable and may not be shared, resold, or redistributed. The underlying PHP code remains GPL-licensed; the license fee covers access, support, and updates.

4. Website Use

airythemes.com is provided for informational purposes — to download our plugins, read documentation, and contact us. You agree to use this Website only for lawful purposes and in accordance with these Terms.

You must not:

• Attempt to gain unauthorized access to any part of the Website or its servers
• Transmit any unsolicited commercial communications ("spam") through our contact form
• Scrape, crawl, or index Website content using automated tools without our prior written consent
• Interfere with the proper operation of the Website

5. Intellectual Property

The Airythemes brand name, logo, website design, documentation, blog content, and marketing materials are the intellectual property of Nxlogy Solutions Pvt Ltd. These are protected by applicable Indian and international intellectual property laws.

Plugin source code is GPL-licensed as described in Section 3. The brand name "Airythemes," "Airy Wishlist," "AiryRank," "Airy Buddy Builder," and other plugin names are trademarks of Nxlogy Solutions Pvt Ltd. You may not use these marks in a way that implies endorsement or affiliation without our written consent.

6. Prohibited Conduct

You agree not to use Airythemes plugins or the Website to:

• Build, distribute, or operate malware, phishing sites, spam networks, or any illegal service
• Circumvent, disable, or interfere with any plugin licensing or activation mechanism
• Reverse-engineer Pro plugin features to create competing products (this does not restrict building competing products independently)
• Misrepresent your affiliation with Airythemes or Nxlogy Solutions in any way
• Use our support channels to harass our team or other users

7. Disclaimer of Warranties

Our free plugins and the Website are provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• The plugins will be error-free or uninterrupted
• The plugins will be compatible with every WordPress theme, plugin, or hosting configuration
• Any defects in the plugins will be corrected within a specific timeframe
• The Website will be available at all times without interruption

You assume full responsibility for determining whether our plugins are suitable for your use case before deploying them on a production site. We strongly recommend testing on a staging environment first.

8. Limitation of Liability

To the maximum extent permitted by applicable Indian law, Nxlogy Solutions Pvt Ltd and its directors, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use or inability to use our plugins or Website
• Any data loss, site downtime, or revenue loss caused directly or indirectly by our plugins
• Unauthorized access to or alteration of your data
• Any third-party plugins or services that interact with our plugins

Our total aggregate liability for any claim arising under these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim. For free plugin users, our aggregate liability shall not exceed ₹1,000 (Indian Rupees One Thousand).

9. Support & Updates

For free plugins, support is provided on a best-effort basis through WordPress.org support forums and GitHub Issues. We do not guarantee response times or resolution for free plugin support requests.

We aim to maintain compatibility with the latest two major WordPress versions. Plugins that become incompatible with a new WordPress release will be updated as soon as reasonably practicable. We do not guarantee perpetual updates or compatibility with future WordPress versions.

Pro plugin users receive support through Freemius ticketing with priority response. Support terms for Pro users are specified in the Freemius Pro License Agreement at the time of purchase.

10. Pro Purchases & Refunds

Pro plugin purchases are processed through Freemius, subject to Freemius's payment terms and our refund policy. We offer a 14-day refund policy for Pro plugin purchases if the plugin does not function as documented and we are unable to resolve the issue within 7 days of a reported ticket.

Refunds are not available for:

• Change of mind after download and installation
• Compatibility issues with third-party plugins not listed in our documentation
• Purchases older than 14 days from the original purchase date
• Renewal charges (please cancel auto-renewal before the renewal date)

11. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of the Republic of India. The Information Technology Act, 2000 and rules thereunder apply where relevant.

Any dispute arising from these Terms or your use of airythemes.com or our plugins shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the competent courts in Noida, Uttar Pradesh, India.

You agree that any claim against Nxlogy Solutions Pvt Ltd must be brought within one (1) year of the event giving rise to the claim, or it will be permanently barred.

12. Changes to These Terms

We may update these Terms at any time. Changes take effect immediately upon publication on this page. The "Last updated" date at the top of this page will be revised accordingly. Continued use of the Website or our Plugins after updated Terms are published constitutes your acceptance of the changes.

For material changes, we will make reasonable efforts to notify users through the Website or via our blog. We encourage you to review these Terms periodically.
